Who is eligible for entry into the Drug Court?

To be eligible person for the Drug Court , a person must:

  • be 17 years of age or older.
  • be charged with a criminal offense which does not involve violent conduct or sexual assault.
  • not have offenses of the nature described above pending before any other court;
  • not have a prior criminal history involving violence or sexual assault.
  • be dependent on a prohibited drug or alcohol.
  • be highly likely to be sentenced to imprisonment for the offense(s) charged.
  • pled guilty to charges as agreed upon by the Assistant Solicitor and the Defense Attorney.
  • have a place of residence within a reasonable commuting distance to the Court.
  • have reliable transportation.
  • not be suffering from any condition that could prevent or restrict the person's active participation in the Drug Court program.
  • be willing to comply with Drug Court requirements.

In addition, the Drug Court will consider an offender's criminal history when deciding if they are suitable for Drug Court.  If they have any matters in their criminal history involving violence or sexual assault, the Court may decide not to accept them.

If an offender is not accepted into the Drug Court program they will be referred back to the Court from which they were referred. The case will be dealt with in that Court as if it had never been referred to the Drug Court.
